Welcome to NotesNinja. These Terms of Use ("Terms") govern your use of the NotesNinja mobile application for iOS (the "App") operated by Lukas Gergel ("us", "we", or "our").
By downloading or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access or use the App.
NotesNinja is a music education game designed to help users learn and memorize musical note names on the staff through interactive gameplay. The App combines arcade-style mechanics with music theory fundamentals to create an engaging learning experience.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on devices that you own or control.
The basic version of the App is provided to you free of charge with limited features and content.
The App may offer in-app purchases or subscriptions to unlock additional features, content, or remove advertisements. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage your subscriptions and turn off auto-renewal by going to your Apple ID account settings.
You must be at least 4 years old to use the App. Users under 13 years of age should use the App under parental or guardian supervision. By using the App, you represent that you meet these requirements or have parental/guardian consent.
The App does not require you to create an account. Your game progress is stored locally on your device and optionally synced through iCloud if enabled.

All content, features, and functionality of the App, including but not limited to all information, software, text, graphics, images, audio, design, and the overall look and feel, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or transmit any content from the App without our prior written consent.
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information when you use the App.
The App is provided "as is" and "as available" without any warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any defects will be corrected.
NotesNinja is designed as a supplementary educational tool and should not be considered a replacement for formal music education or professional instruction.
To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation damages for loss of profits, data, or other intangible losses, arising from your use of the App.
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including breach of these Terms.
You may stop using the App at any time by uninstalling it from your device.
We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Effective Date" at the top of these Terms. Your continued use of the App after any changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.
